Terms and conditions

CHAPTER I GENERAL PROVISIONS

1.The rules of operation of the electronic reservation system of Kerpė hotel & spa operated by UAB “RADA” shall regulate the procedure of sale of accommodation and beauty treatment services (hereinafter referred to as “Services”) offered by Kerpė hotel & spa through UAB “RADA” (registered office address: Vytauto g. 76, Palanga, Lithuania, legal entity code 152516318; phone: 8 601 02944; email: info@Kerpėhotel.lt, hereinafter referred to as “electronic reservation system”), as well as the mutual rights, obligations, and responsibilities of Kerpė hotel & spa and the client.

2. Kerpė hotel & spa reserves the right to amend and supplement these rules at any time. When using the electronic reservation system, the rules in force at the time of booking shall apply.

3. Kerpė hotel & spa accepts no risk and is unconditionally exempt from liability if the customer has not read these rules in detail, even though he has been given the opportunity to do so.

4. The following persons are entitled to make reservations in the electronic reservation system:

4.1. 4.1. persons of legal capacity, i. e. persons who have reached the age of majority and whose legal capacity has not been restricted by a court order;

4.2. 4.2. legal persons acting through authorised representatives;

4.3. 4.3. authorised representatives of all the persons referred to in 4.1 to 4.3 of these Rules.

Note: Minors may only use the services of Kerpė Hotel & Spa in the company of an adult who is responsible for the supervision and safety of minors. An adult is a person over 18 years of age who assumes full responsibility for the care and behaviour of the accompanying children, for the observance of these rules and for the proper care of the children’s belongings.

5. Kerpė hotel & spa has the right to restrict the Customer’s access to the electronic reservation system without notice if the Customer materially breaches the requirements of these Rules, for example the Customer attempts to undermine the stability and/or security of the electronic reservation system.

6. The information in the electronic reservation system is available in Lithuanian and English.

7. The terms used in these Terms and Conditions shall be understood as defined in the Kerpė hotel & spa’s Terms of Service.

SECTION II LOGIN TO THE ELECTRONIC RESERVATION SYSTEM

8. Customers can purchase services by logging into the electronic reservation system and providing the following information:

8.1. 8.1. the name and surname of the person, contact telephone number, e-mail address;

8.2. 8.2. the Customer’s details are entered for the purpose of confirming the booking only.

9. In the event of a change in the Customer’s registration details, the Customer’s details must be updated immediately. Kerpė hotel & spa will not be liable for damages caused to the customer and/or third parties if the customer has provided incorrect and/or incomplete personal data, or has failed to provide or complete the data after the data has changed.

10. The personal data provided by the Client shall be processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing of personal data. When processing and storing the customer’s personal data, Kerpė hotel & spa shall comply with the Privacy Policy and shall ensure the protection of personal data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing. Customer’s personal data is processed for direct marketing purposes only with the customer’s consent. The customer’s consent shall be indicated in the relevant field in the electronic reservation system. The person making a gift voucher to another person or making a reservation on behalf of another person(s) undertakes to ensure that the data of these persons is provided to Kerpė hotel & spa with their knowledge and consent.

11. The customer always has the right, upon request to Kerpė hotel & spa, to have access to his/her personal data processed by Kerpė hotel & spa, to find out how it is processed, to request rectification, destruction of his/her data or to suspend, with the exception of the retention of his/her personal data, the processing of his/her data where the data is processed in a manner that is not in accordance with the provisions of the Law on the Legal Protection of Personal Data and of other legal acts regulating the processing of personal data.

12. The personal data of customers will be used and stored in accordance with the procedures and terms set out in the Privacy Policy.

SECTION III PROCEDURES AND DEADLINES FOR THE SELECTION AND PAYMENT OF RESERVATIONS

13. The Client shall be given the opportunity to choose between the packages offered (according to the offers relevant on the day, the Package may include accommodation, meals and separate beauty services) or standard nights, which are indicated in the booking table, with an indication of the possible choice of date, according to the prices relevant on the day of booking.

14. After having read the Package’s composition and price, the Client may choose the desired available reservation date for the selected room and the additional conditions or package.

15. After selecting the offer, the Customer shall proceed to the next stage of the booking process, where he/she shall fill in his/her personal data and his/her comments/requests regarding the reservation.

16. For the Customer’s reservation to be valid, the Customer must pay the full amount. The Customer may make payment in one of the following ways:

16.1. 16.1. Paysera;

16.2. 16.2. Stripe;

17. After payment has been made via the payment methods specified in clauses 16.1 or 16.2, the Client shall be automatically notified by email confirming the payment and the reservation. The email will contain the Client’s details, the name of the hotel, the total price of the accommodation and the amount paid.

19. Reservation by request. In case of lack of availability in the electronic reservation system, the Client can fill in the enquiry form. After completing the form, the Client receives an email confirmation of the deadline (or lack thereof) and information on how to pay for the services. The Client can pay by simple bank transfer. The booking will only be confirmed upon receipt of payment. Upon payment, the Client will receive an email containing the Client’s details, the name of the hotel, the total cost of the accommodation and other information related to the confirmation of the Booking.

20. The prices of the services in the electronic reservation system are quoted in Euros, including value added tax, and do not include the tourist tax of EUR 2 per day, which is charged additionally in accordance with the tariffs and procedures approved by the Palanga Municipal Council (info available at www.palanga.lt).

21. Before payment, the customer confirms that he/she has read and understood the terms and conditions of the Kerpė hotel & spa electronic reservation system by ticking the box in the booking window next to “I have read and accept the privacy policy and booking rules”. The customer shall not be given the opportunity to make a reservation unless he/she has read and acknowledged these rules.

22. Once Kerpė hotel & spa receives confirmation of payment, a service contract is deemed to have been concluded between the client and Kerpė hotel & spa. Kerpė hotel & spa shall not be liable for the non-conclusion of a service contract due to the failure to receive payment confirmation in time and in accordance with the conditions set out in these Rules.

SECTION IV RULES FOR ORDERING GIFT VOUCHERS

23. The gift voucher(s) confirms the right of the holder of the gift voucher(s) to benefit from the services for the amount specified in the gift voucher(s).

24. Gift voucher(s) holders may only use the services of Kerpė hotel & spa.

25. If the price of the services requested exceeds the value of the gift voucher(s), the difference can be paid in cash or by card at reception.

26. Gift vouchers are not redeemable for cash.

27. Gift vouchers are valid for 6 months from the date of purchase, unless otherwise stated.

28. If the gift vouchers are not used within their validity period, they shall expire and no refund shall be available to make.

29. If the holder of the gift voucher(s) purchases services for an amount less than the amount stated on the gift voucher(s), the remaining amount shall not be refunded to the holder of the gift voucher(s).

30. No VAT invoice shall be issued to the holder of the gift voucher(s) who pays with the gift voucher(s).

31. The gift voucher(s) must be used within one visit.

CHAPTER V PROVISION OF SERVICES, CANCELLATION OF RESERVATIONS

32. The services are provided exclusively by Kerpė Hotel & Spa.

33. The Client has the right to cancel his/her reservation by writing to info@kerpehotel.lt at least 5 days prior to the commencement of the services. In this case, Kerpė hotel & spa is obliged to refund the full amount paid by the client within 10 working days of the provision of all information required for payment.

SECTION VI DISPUTE RESOLUTION

35. Any disputes arising between the Client and Kerpė hotel & spa regarding the execution of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.

36. In order to make a complaint or to resolve a problem, the Customer must contact Kerpė hotel & spa in writing. The following methods of making a complaint and making a written request are available:

36.1 by sending an e-mail to: info@kerpehotel.lt.;

36.2. 36.2. by sending physical mail to this address: Vytauto g. 76, Palanga;

36.3. 36.3. directly at Kerpė hotel & spa on weekdays from 8 am to 5 pm.

37. The Customer may apply for out-of-court settlement of consumer disputes to the State Consumer Rights Protection Service (Vilniaus g. 25, LT-01402 Vilnius, e-mail: tarnyba@vvtat.lt, telephone (8 5) 262 6751, website: www.vvtat.lt ) or fill out the application form on the Electronic Dispute Resolution (EDR) platform http://ec.europa.eu/odr/.

CHAPTER VII FINAL PROVISIONS

38.The provisions of the Kerpė hotel & spa’s Terms of Service shall apply to any other matters not covered by these Terms and Conditions relating to the purchase of services at www.kerpehotel.lt.
